TotalTri.com Copyright Explanation

Certain winning designs have become, or may become, the target of infringers throughout the world. In order to protect your design and our business, it has become necessary to register winning designs with the U.S. Copyright Office.

Under the copyright laws of the United States, original designs are automatically protected by copyright when created. However, there are distinct advantages to officially registering the design with the Copyright Office. First, registration provides a public record of the copyright claim. Additionally, in order to commence legal action against parties who infringe copyrighted designs, registration is mandatory.

TotalTri.com’s new procedure will be as follows: Once a winning submission has been approved for printing, an application to the Copyright Office will be filed by TotalTri.com. TotalTri.com will cover the required filing fees. The registration application will reflect the agreement between TotalTri.com and the designer in that the designer is the owner of the design and the copyright, while TotalTri.com becomes an additional copyright claimant arising under the exclusive right to the design for tee shirt printing and other promotional materials. Once the certificate of registration is received from the Copyright Office, a copy will be forwarded to the designer for their records.

Due to some restrictions under the copyright laws of the United States, not all winning designs are eligible to be copyrighted. Typically, words, phrases, familiar symbols or designs are not eligible to be copyrighted by law. The decision to submit a registration application will be left up to the discretion of TotalTri.com.
